Under the federal framework created by the 2018 Farm Bill, hemp-derived products containing no more than 0.3% Delta-9 THC by dry weight were generally distinguished from federally controlled marijuana. But “legal nationwide” comes with a very big asterisk. State laws can be considerably different, and some states have imposed their own restrictions on hemp-derived THC products. Texas, for example, has recently taken a particularly restrictive approach toward several intoxicating cannabinoids while continuing to permit certain hemp-derived Delta-9 products within its limits.

So while hemp-derived Delta-9 products may be federally permissible under specific conditions, consumers and retailers need to check the laws of the destination state before ordering or shipping. In other words: the internet may be nationwide, but cannabis law definitely isn’t.
